These Terms of Service (the “Terms”) govern your access to and use of the websites, content, and services operated by FAMUS LLC (“FAMUS,” “we,” “us,” or “our”), including famusenergy.com and any preview or successor domain (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

About our products

FAMUS produces non-alcoholic, caffeinated energy beverages. Our products are cocktail-inspired in flavor only — they contain no alcohol.

Each 16oz bottle contains 125mg of natural caffeine. Our products are not recommended for children, people sensitive to caffeine, or women who are pregnant or nursing. Consult your physician before consuming if you have a medical condition or take medication. Nothing on the Site is medical advice.

Product information on the Site (including nutrition facts and ingredients) is provided for convenience and may be updated from time to time. Always refer to the label on the physical bottle for the most accurate and current information.

No online sales at this time

FAMUS products are currently sold exclusively through retail partners. The Site does not process consumer orders or payments. Any pricing, availability, or retailer information shown on the Site — including the store locator — is provided for convenience and is not guaranteed. Contact the retailer to confirm availability before visiting.

If and when online ordering launches, additional terms of sale will apply and will be presented at that time.

Wholesale inquiries

Submitting a wholesale inquiry through the Site does not create a distribution, supply, or partnership agreement. All wholesale relationships are subject to a separate written agreement and approval by FAMUS.

Intellectual property

The Site and its contents — including the FAMUS name, logo, bottle designs, flavor names (including Havana Nights and OG Luxe), photography, graphics, and copy — are owned by or licensed to FAMUS LLC and are protected by trademark, copyright, and other intellectual property laws. You may not use, reproduce, or distribute any of it without our prior written permission, except for personal, non-commercial viewing of the Site.

Acceptable use

You agree not to misuse the Site — including by attempting to gain unauthorized access to our systems or data, scraping content at scale, submitting false or misleading information through our forms, interfering with the Site's operation, or using the Site in violation of any applicable law.

Governing law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Jefferson County, Kentucky.
